The Equal Employment Opportunity Commission (“EEOC”) is an agency of the federal government responsible for enforcing the Americans with Disabilities Act (ADA), which makes it illegal for employers to discriminate against employees who have disabilities.
The EEOC brought a case under the ADA against Prestige Care, Inc., Prestige Senior Living, LLC, and related nursing facilities and assisted living facilities (collectively, “Prestige”) in which it alleged that Prestige had employment practices since 2012 which screened out and/or failed to provide reasonable accommodations to qualified individuals with disabilities in violation of the ADA. The case has been resolved through a Settlement, and a Settlement fund has been created to compensate individuals whose ADA rights the EEOC determines were violated as a result of these alleged practices. A third-party organization, Atticus Administration LLC, is helping to collect information from former Prestige employees in order for them to be considered for a payment from the Settlement fund.
If you received a Notice of Settlement by mail, you have been identified as a person who was employed with Prestige between July 15, 2014 and December 31, 2018 and who may be eligible for compensation from the fund based on the circumstances of your employment. If you wish to be considered for a payment from the Settlement fund, please complete the questionnaire online HERE using your Claimant ID on the letter you received. You can find your Claimant ID above your name and address on the first page. You may also submit the completed questionnaire via email at PrestigeCareSettlement@atticusadmin.com or via mail on the address shown on the Contact Us page. The details that you provide in these forms are necessary for the Claims Administrator and the EEOC to determine if you are eligible to receive money from the Settlement Fund. PLEASE COMPLETE AND RETURN THE QUESTIONNAIRE BY MAY 2, 2024 .
Please note this Settlement fund is the result of a good faith negotiation process, not a court finding that Prestige violated the ADA. Monetary awards made through this claims process may be and likely are subject to federal, state and/or local taxes. You are encouraged to consult a tax professional concerning the tax implications if you receive money through the claims process.
